1. Agreement to Terms

By accessing our website at ninjawebsites.com.au and engaging our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.

2. Services

Ninja Websites provides web design, development, hosting, and related digital services. The specific scope of work will be detailed in a written quote or proposal agreed upon by both parties before work commences.

3. Quotes and Pricing

All quotes are valid for 30 days unless otherwise stated. Prices are in Australian dollars (AUD) and exclude GST unless specified. Additional work outside the agreed scope will be quoted separately before proceeding.

4. Payment Terms

For projects under $1,000, full payment is required upfront. For projects $1,000 and over, a 50% deposit is required to commence work, with the remaining 50% due upon completion before the website goes live. Hosting and maintenance fees are billed annually in advance.

5. Timeline

Project timelines are estimates based on the information provided at the time of quoting. Delays caused by the client (e.g., late content delivery, delayed feedback) may extend the timeline. We will communicate any anticipated delays promptly.

6. Client Responsibilities

You agree to provide all necessary content (text, images, logos) in a timely manner. You warrant that you own or have permission to use all materials you provide to us and that they do not infringe on any third-party rights.

7. Intellectual Property

Upon full payment, you own the final website design and content we create specifically for you. We retain ownership of any proprietary code, frameworks, or tools used in the development process, which we license to you for use on the completed project. We reserve the right to display the completed work in our portfolio unless you request otherwise in writing.

8. Revisions

Our standard packages include two rounds of revisions. Additional revisions beyond this will be quoted at our standard hourly rate. Major changes to the approved design may incur additional charges.

9. Cancellation

Either party may cancel the project with written notice. If you cancel after work has commenced, the deposit is non-refundable and you will be invoiced for work completed to date. If we cancel, we will refund any unused portion of your deposit.

10. Limitation of Liability

To the maximum extent permitted by law, Ninja Websites' liability for any claim arising from our services is limited to the amount paid for those services. We are not liable for any indirect, incidental, or consequential damages.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.

12. Changes to Terms

We may update these Terms from time to time. The latest version will always be available on our website. Continued use of our services after changes constitutes acceptance of the updated Terms.
